In this entire document, we will use certain terms to describe different products and roles. All the text, data, information, software, graphics, images, etc. that we and our affiliates may provide to you, along with our websites and any services, plugins, software, or applications that we may provide, all together constitute the "Website" of Ninequiz. "Users" of Ninequiz are individuals who have created a Ninequiz account, and "Invitees of Ninequiz" are individuals who have been scheduled to meet with Ninequiz Users but may or may not have registered with Ninequiz. "Viewers" of Ninequiz are individuals who access the Ninequiz Website, but may or may not be Users or Invitees of Ninequiz.

Any terms defined in the Terms of Use, End User License Agreement, and Data Processing Addendum, and not otherwise defined in this Privacy Notice, shall be deemed as incorporated by reference into this Privacy Notice

INFORMATION WE COLLECT

WE COLLECT INFORMATION about you directly from you and automatically through your use of our website. We may combine automatically collected information with other information we have collected about you, including from publicly available sources

To help you protect yourself and your information, we encourage you to only provide necessary information for using our website. For example, to schedule an online class, you may only need to provide us with your name, email address, date, and time

INFORMATION PROVIDED VOLUNTARILY BY YOU

Ninequiz collects the following information directly from Users, Invited Users, or Viewers of Ninequiz, or through third parties related to Users, Invited Users, or Viewers

1. Appointment information

Users of Ninequiz, Invited Users, or third parties may voluntarily provide us with certain information. This may include name, email address, and phone number; email address of others; class topic; and any other information provided to us or requested by the User of Ninequiz when scheduling, as per Ninequiz's Terms of Use. If you have received an invitation from a User of Ninequiz but do not wish to become a User of Ninequiz, please contact the User of Ninequiz who sent the invitation through alternative means to set up your meeting

2. Online class notifications

Users of Ninequiz may connect their calendar with Ninequiz. Our calendar integration only checks the duration and availability status of events in your calendar so that we do not schedule appointments for you when you are busy. We never store the people you are meeting with, their email addresses, meeting titles, or any other details of appointments in your connected calendar

3. Payment information

If you purchase the premium version of Ninequiz, our third-party payment processor will collect and store your billing address and credit card information. We store the last four digits of your credit card, card type, and expiration date.

AUTOMATICALLY COLLECTED INFORMATION

We and our service providers use Cookies, web beacons, and other technologies to collect and store certain types of information when you interact with us through your computer or mobile device, depending on your opt-out choices (see Your Rights and Choices section below). The use of these technologies helps us customize your experience with our website, improve your experience, and tailor marketing messages. Below are some types of information we collect

1. Logs and Device Data

When you use Ninequiz, our servers automatically record information ("log data") that your browser sends whenever you access our website. This log data may include the web address you visited on our site, device type, operating system, browser type, unique device identifier, IP address, mobile network provider, and time zone or location. The extent to which we collect this information depends on the type of device you are using and its settings. For example, different types of information may be available depending on whether you are using a Mac or PC, iPhone or Android phone. 2. Cookie data.

Depending on how you access our services and your opt-out choices, we may use "Cookies" (a small text file that your computer sends each time you access our website, unique to your Ninequiz account or your browser) or similar technologies to record log data. When we use Cookies, we may use "session" Cookies (that last until you close your browser) or "persistent" Cookies (that last until you or your browser delete them). For example, we may use Cookies to help you stay logged in to Ninequiz. Some of the Cookies we use are linked to your Ninequiz account (including personal information about you, such as the email address you provided to us), while others are not. Ninequiz provides a centralized cookie management service across the entire Ninequiz application. You can find a link to manage your cookie preferences at the bottom of the Ninequiz homepage.

3. Other web analytics services.

Depending on your opt-out preferences (see "Your Rights and Choices" below), we may use third-party service providers such as Google Analytics to provide web analytics and audience measurement services for Ninequiz related to the activity of our website, including the collection and tracking of certain data and information related to the characteristics and activities of visitors to Ninequiz. You can opt out of related cookies by using the opt-out features on the respective websites.

How We Use Your Information

We may use the information we collect about you, including personal data, to

Provide Ninequiz services.

We will use your information to provide our Ninequiz website application to you, including scheduling and creating conditions; managing your account; answering your questions; and for other customer support and service purposes. We use the payment information you provide to us to notify you of past, current, and upcoming fees, to allow us to display your payment history on your payment page within the website, and to perform internal financial processes, such as checking the status of a credit card fee. In case of credit card disputes, we also share account information with your bank to verify the legitimacy of the fee.

2. Understand and Improve Our Product

We will conduct research and analysis on how you use, or express interest in, our products, services, or content, or products, services, or content provided by others. We do this to help improve our existing products and develop new ones

3. Communicating with You

3.1 Service-related Communications.

We may send you service-related emails and administrative emails to ensure the normal operation of our services. We may also send you emails regarding appointments in your calendar. These messages are considered part of the service and you cannot opt out of receiving these messages.

3.2 Promotional Communication

Depending on your opt-in preferences, we may send you emails about new product features or other news related to Ninequiz or topics that we believe are relevant to you. You can choose to unsubscribe from these notifications at any time. Please visit the "Your Rights and Choices" section below. For Invited Ninequiz Users, rest assured that we do not use the email address you provide to schedule appointments with Ninequiz Users to send any direct marketing materials.

3.3 Responding to Your Requests

We will also use your information to respond to your questions or comments, and to address your feedback or reviews.

3.4 Operations

We may contact you to inform you about changes to our services, updates on our service offerings, and other important notifications related to the service, such as changes to our terms of service or regarding security or fraud notifications.

4. Protecting Rights and Interests

We will use your information to protect our rights and interests, as well as the rights and interests of our users and any other individuals, as well as to enforce this notice or our Terms of Use.

5. Compliance with Legal Requirements

We may use your information to comply with legal obligations or current regulations, including complying with requests from law enforcement agencies or other government agencies, or in legal proceedings related to Ninequiz

6. Other

We may also use your information to manage our business operations or perform other functions as described to you at the time of collection with your consent

We may share your information with others.

We do not sell your information to any third party or disclose that information in exchange for money or other valuable consideration. We do not share your personal data with others unless stated in this notice or when we notify you and provide you with the opportunity to opt-out of sharing your personal data

We will never use the data of Invited Persons to directly market our or any third-party products through email, SMS, mail, or other similar communication channels to advertise or promote the use of our or any third-party products

We may share the information we collect about you, including personal data, in the following ways

1. With third-party service providers, agents, contractors, or government organizations

We use other companies, agents or contractors (“Service Providers”) to perform services on our behalf or to assist us in providing services to you

We may partner with Service Providers to process credit card transactions or other payment methods. We may also invite Service Providers to provide services such as monitoring and developing Ninequiz services; supporting communications, infrastructure, and IT services; customer service; analyzing and improving data. These Service Providers may have access to your personal information or other information to provide these functions. In addition, some types of information listed above that we require may be collected by third-party Service Providers on our behalf

We may share information with service providers and government agencies for legal, security, and safety purposes. This includes sharing information to enforce policies or contracts, address security breaches, and support fraud investigations, security issues, or other concerns

We require our service providers to agree to reasonable steps to secure the personal data we provide to them. We do not allow them to use or disclose your personal data except in connection with their provision of services.

2. Branches.

We may disclose information to current or future branches or subsidiaries for research, marketing, and other purposes consistent with this privacy notice.

We may share your email address and subscription information with an authorized agent of your company if you are using Ninequiz as a paying member of an organization or using your organization's email domain (thus indicating that you are a member of the organization) upon request for them to manage the account for the company.

Your Rights and Choices

1. Account

To keep your personal data accurate and complete, you can log in to review and update your account information, including contact and payment information, through your account settings page. You can also contact us to request information about the personal data we have collected from you and to request correction, updates, or deletion of that personal data. We will make our best efforts to comply with your requests in accordance with any legal and contractual obligations. If you would like to request to cancel your account or to request that we delete or no longer use your account information to provide you with our website, please contact us via email: info@ninequiz.com or at the address provided at the end of this notice. Upon receiving your email request, we will process it, including but not limited to requests for correction, updates, or deletion of data, within 10 working days and notify you by email. Under applicable law, we will keep and only use your account information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements

2. E-mail.

As described above, if you do not wish to receive promotional emails from us, you can opt-out at any time by clicking on the unsubscribe link provided in the email. Please note that it may take up to ten (10) days to process your request. Also note that if you choose not to receive marketing information from us, we may continue to send you service-related emails that are not available for opt-out. If you do not want to receive any service-related emails from us, you have the option to delete your account.

Some of the services used provide the option to opt-out.

Ninequiz places great importance on the security of your personal data. We work hard to protect the personal data you provide from loss, misuse, unauthorized access or disclosure. Given the nature of communication and information processing technology, nothing can guarantee that personal data will be completely safe from being accessed, altered or destroyed due to any violation of our physical, technical and managerial protection measures

You should take steps to protect against unauthorized access to your device and account by choosing a complex and unique password that no one else knows or can easily guess, and keeping your login information and password private. We are not responsible for any lost, stolen, or compromised passwords, or for any activity on your account through unauthorized password activity

We retain the personal data we collect for a reasonable period of time necessary to fulfill the purposes for which the data was collected, to perform our contractual and legal obligations, as well as for any applicable statute of limitations for the purpose of bringing and defending claims.

Third-Party Links

Our website may contain links to third-party websites and applications. USERS OUTSIDE OF VIETNAM

Our application servers and databases are located in Vietnam

If you are an individual residing in the European Economic Area, United Kingdom, Canada, or another jurisdiction outside of Vietnam with laws and regulations governing the collection, use, and disclosure of personal data different from those of Vietnam, please note that the information we collect (including through methods such as cookies and other web technologies) will be processed and stored in Vietnam, or in other countries where we or our third-party service providers operate. By submitting your personal data to Ninequiz and using Ninequiz, you expressly consent to the transfer, processing, and storage of your personal data in Vietnam or another jurisdiction that may not provide the same level of privacy protection as the country where you reside or are a citizen.

Regarding our website's operations, Ninequiz may transfer your personal data to various locations, which may include locations both within and outside the European Economic Area. We process personal data sent in connection with individuals in Europe through Standard Contractual Clauses.

DISPUTE RESOLUTION

1. This Agreement shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam for all matters and aspects related to this Agreement

2. Arbitration rights:

You and Ninequiz acknowledge that in the event of any disputes or conflicts that You and Ninequiz cannot resolve through negotiation, mediation, or settlement, the case and dispute shall be resolved by the People's Court where Ninequiz is headquartered

CHANGES TO THIS NOTICE

This notice is effective from the date stated above. This notice may be amended if there are significant changes in the way information is processed at Ninequiz, or to clarify our notice or correct typographical errors. If any changes are made, we will post them on this page, so please check back regularly. If you continue to use Ninequiz after those changes take effect, you agree to the modified notice.
